Terms of Service

1. Agreement

By creating an account or using Harakumo ("the Service"), you agree to these Terms of Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. The Service

Harakumo provides cloud infrastructure services including hosting and deploys, edge functions, file storage, databases, domain registration and management, email delivery, sign-in and payment tools for your own users, AI model access, and related developer tooling. Services are provided on an "as available" basis during the public beta; features may change or be discontinued with notice.

3. Accounts and organizations

• You are responsible for safeguarding your credentials and API keys.
• Resources belong to organizations; organization owners control member access and roles.
• You must provide accurate account information and be at least 16 years old.

4. Acceptable use

You agree not to use the Service to:

• violate any law, infringe intellectual property, or distribute malware;
• send spam or unsolicited bulk communications;
• attempt to gain unauthorized access to other tenants' data or the platform itself;
• run workloads that intentionally degrade the Service for other customers.

5. Your content

You retain all rights to code, data, and content you deploy. You grant Harakumo only the rights needed to operate the Service — storing, executing, and serving your content at your direction. We do not use your content to train models or for advertising.

6. Billing

• Plans are priced per workspace and billed monthly in advance. An upgrade takes effect at once and is charged the prorated difference. A move to a cheaper paid plan takes effect at the next renewal. You can cancel at any time; paid features remain active until the end of the billing period.
• Usage beyond what a plan includes, such as additional AI usage and domain purchases, renewals and transfers, is paid from a prepaid workspace balance. Top-ups are paid in advance, do not expire and are not refundable. A remaining balance is forfeited when the workspace is deleted, and only after you confirm that.
• Domain prices are shown before each purchase or renewal. You can set an optional monthly spending limit on usage paid from the balance.
• A saved card is charged only for your plan, for top-ups or purchases you choose to pay by card, and for auto-reload or auto-renew when you turn them on.
• Harakumo Payments charges sellers 3.9% + 30¢ per successful charge. A seller's earnings from each payment are held for 7 days before they can be withdrawn.
• Fees are non-refundable except where required by law.

7. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these terms, with notice where practicable. Upon termination we will make your data available for export for 30 days, except where legal obligations require otherwise.

8. Disclaimers and liability

The Service is provided without warranties of any kind. To the maximum extent permitted by law, Harakumo's aggregate liability is limited to the amounts you paid in the twelve months preceding the claim. Nothing in these terms limits liability that cannot be limited by law.

9. Changes

We may update these terms; material changes will be announced by email or in the dashboard at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
